Decree 28/2016, 2nd of February, Holiday Rental Properties in Andalucia.

To operate a holiday rental property in Andalucia, it must comply with Decree 28/2016 (effective May 12, 2016, updated January 2024). This decree ensures quality standards for privately owned holiday rentals.

The decree was brought in to ensure the quality and standard of privately owned properties which are being rented out for holiday use.

Though this regulation may seem complex, there’s no need to worry if your property meets the requirements and is managed to a high standard.

Steps to apply for the Tourist License Number:

1. Obtain a Digital Certificate

The FNMT Digital Certificate is an electronic certification issued by the FNMT-RCM that links the holder to verified signature data, confirming their identity.

As a secure digital file containing the user’s identification details, it allows the user to verify their identity online confidentially. By installing it on a computer, they can securely exchange information with individuals and organizations.

Application Steps:

1. Provide your ID documents.

2. Attend a scheduled appointment at the local Town Hall with your application number.

3. Receive Digital Certificate.

Eligibility:

Anyone over 18, Spanish or foreign, holding a DNI, NIE, or NIF, can apply for the digital certificate.

Why it's important:

The Digital Certificate enables you to complete online processes with the Spanish Public Administration, including Property Registration to obtain your VUT/MA/ Tourist License number.

2. Register your Property with the Junta de Andalucia

To apply for a Tourist License, log into the Junta de Andalucia online office using your digital certificate. Complete the online form with accurate details about yourself and your property, and upload the necessary documents.

Ensure all information is filled in correctly to prevent delays or rejection of your application.

Once submitted, you will receive a response from the Málaga Provincial Delegation of Tourism with your new Tourist Registration Number (VFT/MA/_____). This number allows you to begin marketing your property online as a holiday rental.

After scheduling and attending your appointment at the Town Hall, and submitting your identification documents along with the application number, your digital certificate will be issued immediately

Upon successful completion of the application, provided that all documents are accurate and the form is correctly filled out, the Málaga Provincial Delegation of Tourism will promptly issue the Tourist Registration Number. The process usually takes a couple of days.

1. Registration: All holiday rental properties must be registered with the Andalusian Tourism Registry.

2. Occupancy License: The property must have a valid occupancy license (Licencia de Ocupación) issued by the local town hall.

3. Compliance with Regulations: The property must comply with safety, health, and accessibility regulations.

4. Furnishing and Equipment: The property should be adequately furnished and equipped for tourist accommodation, including basic amenities and appliances.

5. Information for Guests: Guests must be provided with information about the property, local area, emergency contacts, and any rules or regulations.

6. Other requirements:

  • Rooms with direct ventilation (windows out to exterior or patios)
  • System of blinds or any other to darken the rooms (curtains, persiana’s/blinds)
  • Cooling (May to September) and Heating (October to April)
  • First aid kit
  • Sheets of complaints and claims. (6 sheets must be completed for one claim!)
  • Poster announcing there are sheets for complaints and claims (clearly displayed)
  • Cleaning for arrival and departure
  • 24/7 Contact Phone Number

7. Tax Compliance: Property owners must comply with tax regulations related to holiday rentals, including declaring income and paying applicable taxes.

All Holiday Rental Portals require the Tourist License Number to advertise your Holiday Rental Property online. Therefore, it isn’t possible, and is illegal, to advertise your property for holiday rentals without it.

The Málaga Provincial Delegation of Tourism conduct inspections to ensure that all properties rented out for short term are fully complying with the regulations.

They can impose fines of between 2,000 and 18,000 euros and closing down of the property for up to 6 months.

The Málaga Provincial Delegation of Tourism conduct inspections at random based on information taken from internet advertising.

If your property is advertised online without the Tourist License Number, you may be fined up to 18,000 euros.

It is mandatory for all Holiday Rental Properties to display their Tourist License Number on all online advertisements.

Please note that if this requirement is not met, it suggests that the property may not be legally registered and might not adhere to the necessary legal obligations.

We strongly advise against booking any Holiday Rental Property that does not have a valid Tourist License Number.

To verify if a tourist license number for a holiday rental property in Andalusia is real, you can follow these steps:

1. Check the Official Registry: Visit the official website of the Andalusian Tourism Registry (Registro de Turismo de Andalucía) to verify the authenticity of the license number.

2. Contact Authorities: Reach out to the Andalusian Tourism Registry or the local tourism office directly via phone or email to inquire about the validity of the license number. They should be able to confirm whether the property is properly registered.

3. Ask for Documentation: Request documentation from the property owner or manager that verifies the legitimacy of the tourist license number. This could include a copy of the license certificate or confirmation from the relevant authorities.

Under the new decree, (Decreto 28/2016, 2 de febrero, Viviendas con fines turísticos de Andalucía) all guests over the age of 16 years have to provide a copy of their passport or ID and fill out a form which is to be filed to the relevant authrorities within 24 hours of arrival. These must be retained by the owner or representative for the period of 3 years.

A rental contract has to be completed for all rentals with all relevant information, i.e. length of stay, price for the stay, arrival time, departure time etc. This contract has to be retained by the owner or representative for a period of 1 year.
